Surprise! Neighbors Sue HOA, Say It’s Useless

6/29/2023 Wichita, KS – In a shocking revelation, residents of the Maplewood Estates have accused their Homeowners Association (HOA) of being useless and incompetent, after months of failing to address a serious issue: a trash can on the roof.

The trash can belongs to Mr. Bob Smith, who lives at 314 Maple Street. According to his neighbors, Mr. Smith decided to store his trash can on the roof of his garage, on top of the gutters, leaning against the second floor porch eave, for reasons unknown.

“It’s an eyesore, a health hazard, and a safety risk,” said Mrs. Jane Jones, who lives across the street from Mr. Smith. “We’ve been complaining to the HOA for months, but they haven’t done anything about it. They just keep saying they’re looking into it, or they’re waiting for a response from Mr. Smith, or they’re busy with other matters.”

Other neighbors have also expressed their frustration and disbelief at the HOA’s inaction. Mr. Tom Brown, who lives next door to Mr. Smith, said he has had several unpleasant encounters with the trash can owner.

“One time, I asked him politely to remove his trash can from the roof, and he told me to mind my own business,” said Mr. Brown. “Another time, I saw him throwing more garbage into the trash can from his second floor window. He missed and some of it landed on my lawn. When I confronted him about it, he said it was an accident and that I should be grateful he’s recycling.”

Mr. Brown also claimed that Mr. Smith’s trash can has attracted unwanted visitors to the neighborhood, such as raccoons, rats, and birds.

“I’ve seen them crawling on his roof, digging through his trash, and making a mess,” said Mr. Brown. “They’ve also been coming to my yard and other people’s yards, looking for more food. It’s disgusting and unsanitary.”

The HOA president, Mr. John Meddlestone, declined to comment on the situation, saying he was too busy to talk to the press. However, he did send an email to all the residents of Maplewood Estates, assuring them that the HOA was working hard to resolve the issue as soon as possible.

“We appreciate your patience and understanding during this difficult time,” wrote Mr. Meddlestone. “We are aware of your concerns and we are doing everything in our power to enforce the rules and regulations of our community. We hope to have a positive outcome soon.”

However, some neighbors are not convinced by Mr. Meddlestone’s words.

“He’s full of crap,” said Mrs. Jones. “He’s just trying to cover his ass and avoid responsibility. He’s probably friends with Mr. Smith or something.”

Mrs. Jones said she and other neighbors are taking legal action against the HOA and Mr. Smith if they don’t remove the trash can from the roof immediately.

“We pay our dues every month for what? For nothing,” said Mrs. Jones. “We deserve better than this. We deserve a clean and beautiful neighborhood, not a dump.”

The HOA has not responded to the lawsuit yet, but has issued a statement saying that it is aware of the situation and is working on finding a solution. The statement also said that the HOA values its members and strives to maintain a harmonious and pleasant community.
